Public-Private Partnerships (PPP)

Private Public Partnership (PPP) is a contracting model usually used for large construction and infrastructure projects. The model implies that a private company (SPV) enters into a contract with a public sector authority based on such authority’s description of the project and the private company is responsible for the design, financing, construction, operation and maintenance (DBFO) of the project for a given period of time, usually 20 to 25 years, with a down-payment period correspondingly.

In Norway, the PPP-concept has been used for building schools, nursery homes and infrastructure projects, so far limited to road building projects. PPP road projects are based on a concession model (DBFO).

In 2001, the Parliament decided to realise three pilot PPP road-building projects based on DBFO; 

  • E 39 Orkdalsvegen (Klett – Bårdshaug) (2004-05)
  • E 39 Flekkefjord – Lyngdal (2005-06)
  • E 18 Grimstad – Kristiansand (2006-08). 

On the first of the above mentioned, our lawyers represented the concession company (SPV). On the second, our lawyers represented the designers/consultants. On the third, we initially represented one of the bidders, who was not awarded. Later, we represented a number of sub-contractors towards the consortium, and thereafter, we represented the construction JV towards the consortium. 

Our lawyers also have international experience within the PPP sector covering Independent Power Producers (IPPs) in Europe, Asia and Sub-Sahara Africa.
