SANDS assisted NHIndustries SAS
The Norwegian Government and NHIndustries SAS have reached an amicable settlement that brings all disputes between the parties related to the Norwegian NH90 programme to an end. As a result of the settlement, all legal proceedings between the parties are now formally concluded.
Under the agreement, NHIndustries SAS will take back all NH90 helicopters previously delivered to Norway, together with associated spare parts, tools, and mission-specific equipment. The company will assume full responsibility for the materiel and reintegrate it into the NH90 programme, making sought-after parts and equipment available to other users of the NH90 platform.
As part of the settlement, NHIndustries SAS will pay the Norwegian Government an amount of EUR 305 million, in addition to approximately EUR 70 million previously paid under bank guarantees. The solution reflects the parties’ shared intention to bring all related matters to a definitive and constructive close.
The process has been characterised by constructive dialogue and a mutual willingness to find a resolution, including through mediation facilitated by the Oslo District Court, which conducted the process in a professional and trustworthy manner.
